Does my auto insurance pay the medical expenses directly or do I?

You may have wondered at one point if you were in an automobile accident that wasn’t your fault who pays the medical expenses if I have health insurance? Well right after the accident the medical expenses are taken care of usually by your health insurance if you have one. Your health insurance then will take it up with the liable parties auto insurance to pay for the medical costs. This process is called subrogation when the insurance companies work with each other to pay for costs. If you do not have health insurance, the medical costs still have to be paid for, but you then would have to talk with the liable parties auto insurance to get the medical costs paid for immediately.

After an accident your medical coverage will pay for the costs, but it does not end there. Some people think that because they have medical coverage that they will also receive payments from the liable parties auto insurance for medical costs. Well it does not work that way, and getting dual benefits is illegal. If you are caught in a situation where you are not sure what to do or what is going on, you should consult an attorney immediately to get everything straightened out. In most cases, medical problems resulting from an accident will be completely taken care of from the liable persons auto insurance, even if your health insurance initially covered the costs. Your health insurance will get paid back from the other persons insurance and you will not have to pay anything as a result.

After the medical costs are taken care of, some people do not want to stop there. They feel that the liable parties insurance should pay them for their pain and suffering as a result of their insured driver. A lot of times, a person will be compensated for pain and suffering, and the liable persons insurance will work quickly to get that settlement.

In other cases, if the offered settlement for pain and suffering is not enough, you may hire an attorney and take it the next step. You can sue the other person to try and get a better settlement for your pain and suffering, but in most cases, the liable persons insurance will not let it get that far. They will want a settlement fast, so you have to be careful that you are not being manipulated by the liable persons insurance company. Take your time and make sure you are getting a fair settlement.
